INTELLECTUAL PROPERTY RIGHTS

The Intellectual Property Rights are rights endowed upon the creators for their new, innovative and unique creations of their minds. Intellectual property is an intangible property or proprietary asset, which applies to any product of the human intellect that has commercial value. These rights are largely covered by the laws governing Patents, Trademarks, Copyright and Designs. These various laws protect the holder of IP rights from third party encroachment of these rights. It also allows them to exercise various exclusive rights over their intellectual property.

TRADEMARK REGISTRATIONS

Within three days of submitting an application, you can use the TM symbol alongside your brand name. This will ensure that no other business can register the same or similar brand name.

TRADEMARK ASSIGNMENT

You are entitled to transfer your trademark rights for consideration to anyone. Before transferring trademark rights to another party, an agreement must be signed and registered.

TRADEMARK OBJECTION

If you receive an objection by the Intellectual Property department against the brand name that you have applied for, all you need is lawyer to respond to this objection within 30 days.

TRADEMARK RENEWAL

Trademarks have a validity of 10 years. After the expiration of this time period, the  IP department will eventually strike it off the register, if the same is not renewed.
